California Is Actively Blocking the Federal Investigation

This is the most significant development and it's happening right now.

U.S. Attorney Essayli stated that California is refusing to comply with a federal request for voter registration records that the DOJ says are needed to audit the state's voter rolls and assess compliance with federal election laws. The dispute stems from a DOJ lawsuit against California Secretary of State Shirley Weber. Federal officials argue they are entitled under the National Voter Registration Act, the Help America Vote Act, and the Civil Rights Act to obtain the state's voter registration list.

The DOJ has been requesting access to California's statewide voter registration database for over a year. Copies of every voter registration application filed between December 2023 and July 2025 were requested. California's refusal is based on privacy restrictions that federal officials contend are superseded by federal election law. The case is currently before the Ninth Circuit Court of Appeals.

Newsom just legislatively fortified the blockade:

Governor Newsom signed legislation specifically prohibiting anyone from providing access to voter rolls, voter lists, or certified voting technology to law enforcement agents — including federal agents — absent a court order. It also restricts peace officers from interfering with election administration and establishes criminal penalties for taking ballots from election officials.

This law was signed two weeks before the primary. The timing speaks for itself.

The Voter ID Loophole — The Illegal Alien Gateway

This is where the noncitizen voting concern becomes concrete and structural, not theoretical.

California allows first-time voters to register using a gym membership card, employer ID card, credit or debit card, prescription drug label, or insurance card — when a voter fails to provide a Social Security number or driver's license. Insurance cards have drawn particular scrutiny because California provides free health coverage to undocumented immigrants.

So the chain is: illegal alien receives California free health insurance → gets insurance card → uses insurance card to register to vote with no SSN required → receives mail ballot at a registered address.

Other structural vulnerabilities Essayli flagged include failing to promptly remove deceased voters from the rolls and insufficient limits on third-party ballot harvesting.

The DMV Auto-Registration Problem

California gives illegal aliens driver's licenses (AB 60). California also has an automatic motor-voter registration law. Hundreds of noncitizens were purged from voter rolls in three major California counties after having been registered through the motor voter program. Those are the ones caught. The DMV publicly claimed none were illegal aliens — a claim election integrity groups dispute given the state issues licenses specifically to people without legal status.

The federal voter roll audit would cross-reference registrations against Social Security Administration and DHS databases — which is exactly why California is fighting the audit in court.

What a Successful Federal Investigation Looks Like

If the DOJ wins in the Ninth Circuit and gets the voter rolls:

  1. SSN cross-check — every registration without a valid SSN flagged and cross-referenced against DHS immigration databases

  2. Insurance card registrants — pull every registration that used an insurance card as ID, cross-reference against Covered California (the state's Medicaid/free insurance program for illegals)

  3. Ballot return audit — did the suspicious registrations actually cast ballots, and did those ballots arrive from non-residential addresses

  4. Armstrong network expansion — 20 years of operation has financial trails, phone records, co-conspirators

The biggest obstacle is the Ninth Circuit — historically the most left-leaning federal appeals court in the country. If they side with California, the DOJ's options become a Supreme Court appeal or a congressional remedy forcing state compliance.

Bottom Line

California isn't just refusing to cooperate — it passed a law making cooperation a crime. That is the single most telling data point in this entire story. Innocent voter rolls don't need legislation to protect them from auditors.

It Is Real — Here's the Documented Evidence

National confirmed cases are growing:

Since April 2025, the SAVE program has identified more than 24,000 cases of potential non-U.S. citizens on voter rolls nationwide, all referred to ICE's Homeland Security Investigations for further action. These aren't allegations — these are federal referrals.

Iowa is the proof-of-concept:

Iowa identified 277 confirmed noncitizens on its 2024 voter registration list. Of those, 40 attempted to vote. Five were caught before ballots were counted. Thirty-five unlawful ballots were actually tallied. Critically, the Biden-Harris administration had refused to provide Iowa with the citizenship verification data it requested — which only became available under Trump's SAVE program expansion.

That pattern — state asks for verification, federal government refuses — is exactly what's playing out in California right now, in reverse: it's California refusing to hand over rolls to the feds.

California's Unique Structural Exposure

California is worse than other states for one specific reason — the combination of policies creates a funnel:

California allows first-time voters to register using an insurance card as ID — and California provides free health coverage to undocumented immigrants. This is the pathway: illegal alien gets state-funded health insurance → uses insurance card as voter registration ID → no Social Security number required.

DHS overhauled the SAVE program in 2025 to include Social Security data, and Trump waived fees so states could run bulk searches of their voter rolls against it. Every other state can now run their rolls against federal immigration databases. California refuses to participate.

California Refuses the One Tool That Would Prove or Disprove It

Assistant Attorney General Harmeet Dhillon demanded California provide its complete statewide voter registration list — including names, dates of birth, addresses, and driver's license or last four SSN digits — plus every voter registration application filed between December 2023 and July 2025. California refused, and the case is now in federal court.

The logic is simple: if California's rolls are clean, handing them over proves it. Refusing to hand them over proves nothing — except that California doesn't want them checked.

The Orange County Study

An independent study using skip-tracing and identity verification databases estimated that roughly one in five ballots counted in Orange County's 2024 election may have involved non-citizens, invalid voters, or voters who simply don't exist — totaling an estimated 298,000 votes across six congressional districts, all of which went to Democrat candidates.

This study has not been officially validated, but its methodology — cross-referencing voter data against independent identity databases — is the same approach the DOJ is trying to apply statewide.

The SAVE Act — Congress's Legislative Fix

The SAVE America Act passed the House in February 2026. It would require documentary proof of U.S. citizenship to register to vote and mandate photo ID for all voters including mail ballot voters. As of March 2026 it awaits Senate action.

If it passes the Senate, California would be forced to verify citizenship at registration — eliminating the insurance card loophole entirely. That is why California's congressional delegation is fighting it with everything they have.

Bottom Line

The same state that gives illegal aliens free health insurance, accepts that insurance card as voter registration ID, automatically registers DMV customers, allows mass ballot harvesting, and just passed a law making it a crime to show federal agents the voter rolls — is the state telling you noncitizen voting isn't happening. The federal investigation exists precisely because that story doesn't add up.
